What does the 5% accessible rule mean for a Bethlehem event?

Is the accessible unit ADA compliant?
PolyJohn states the We'll Care III is designed to exceed ADA portable toilet guidelines and lists it as ADA compliant. We describe it as wheelchair-accessible. Whether your event meets the ADA depends on the whole setup: a firm path, level ground, and the 5% rule in 2010 ADA Standards §213.2. Confirm with your permit office or venue.
How many accessible units does a public event in Bethlehem need?

Is the accessible unit exempt on a construction site?
Single-user portable toilets used only by construction workers are exempt under the 2010 ADA Standards. If the public, inspectors or office staff will use the units, or your contract requires it, add one accessible unit. OSHA counts it toward the 1926.51(c) toilet total.
